These Terms of Service ("Terms") form a legally binding agreement between ZephyrFuture Inc. ("ZephyrFuture", "we", "us", or "our") and you ("you" or "User") governing your access to and use of LingoAI Keyboard and related applications, services, and websites (collectively, the "Services").
By installing, accessing, or using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old, or the minimum legal age in your jurisdiction. If you are under the age of majority, your use must be supervised by a parent or legal guardian who accepts these Terms on your behalf.
2. License to Use
Subject to compliance with these Terms, ZephyrFuture grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Services on compatible devices you own or control.
You may not:
- Reverse engineer, decompile, or derive source code.
- Copy, distribute, or modify the Services beyond permitted use.
- Use the Services to build a competing product.
- Circumvent technical safeguards, usage limits, or access controls.
3. Account Registration
Some features require an account. You agree to:
- Provide accurate and complete account information.
- Maintain confidentiality of login credentials.
- Accept responsibility for activity under your account.
We may suspend or terminate accounts used unlawfully, fraudulently, or in violation of these Terms.
4. User Content
"User Content" includes text, prompts, and other materials you input, submit, or transmit through the Services. You retain ownership of your User Content.
You grant ZephyrFuture a worldwide, royalty-free, non-exclusive license to process User Content solely to provide, maintain, improve, and personalize the Services.
5. Keyboard Behavior and Sensitive Input
The Services may process typed text to provide prediction, correction, and learning features. We do not intentionally collect or store passwords, payment card numbers, or similar credentials, and we apply best-effort filtering of secure fields where available.
For maximum security, use your system keyboard when entering highly sensitive information.
6. Prohibited Use
You agree not to use the Services to:
- Engage in unlawful, harmful, fraudulent, or abusive activity.
- Infringe third-party intellectual property, privacy, or other rights.
- Distribute malware, spam, or unauthorized advertising.
- Collect personal information without consent.
- Disrupt, interfere with, or gain unauthorized access to systems.
- Use bots/scripts to access or modify the Services unless explicitly permitted.
- Benchmark or replicate the Services for a competing offering without written consent.
7. Service Availability and Changes
We may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted or error-free availability and may restrict access for security, operational, or legal reasons.
8. Intellectual Property
All rights, title, and interest in the Services (including software, models, design, trademarks, and related materials) belong to ZephyrFuture or its licensors. No rights are granted beyond the license described in Section 2.
9. Third-Party Services
The Services may interact with third-party apps or websites. ZephyrFuture is not responsible for third-party content, products, services, or practices. Your use of third-party services is governed by their own terms and privacy policies.
10. Subscription and Payment
Certain features may be paid (subscriptions, in-app purchases, or upgrades). Billing is typically handled through app marketplaces or payment providers. Renewal, cancellation, and refunds are governed by the relevant provider, unless stated otherwise.
11. Termination
We may suspend or terminate access if you violate these Terms, applicable law, or if required by law.
On termination, your license ends immediately. Provisions that should survive termination (including ownership, disclaimers, and limitations of liability) remain in effect.
12. Disclaimers
To the maximum extent permitted by law, Services are provided "as is" and "as available" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.
13. Limitation of Liability
To the fullest extent permitted by law, ZephyrFuture is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, revenue, or service interruption.
ZephyrFuture's total liability for any claim arising from these Terms or the Services is limited to the greater of:
- The amount paid by you to ZephyrFuture in the 12 months before the claim.
- USD $50.
14. Indemnification
You agree to defend, indemnify, and hold harmless ZephyrFuture and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
15. International Use and Data Transfers
The Services may be operated from infrastructure in the United States and other jurisdictions. By using the Services, you acknowledge related data processing and transfers as described in our Privacy Policy.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without conflict-of-law principles. Disputes will be resolved by binding arbitration on an individual basis, unless arbitration is unenforceable for a specific claim.
Where arbitration does not apply, disputes will be subject to the exclusive jurisdiction of state and federal courts in California, United States.
17. Changes to These Terms
We may revise these Terms from time to time. Material changes will include an updated date and additional notice where required by law. Continued use after the effective date means acceptance of the revised Terms.
